I'm hopefully getting my whistleblower retaliation lawsuit unstayed in a week or two, & Apple's apparently panicking. Their lawyers tried to add another 2 month+ delay via informal emails to court staff & without filing anything to the judge, & it almost worked. They're a bunch of smooth criminals.

I had another bankruptcy hearing today & Apple's retaliation lawyers showed up again. The hearing was just a standard Ch7 mtg for creditors to ask me basic bankruptcy questions. Apple's lawyers said they were "members of the public." I don't understand how Apple's lawyers have so much free time.

Today was my 11 US Code § 341 "Meeting of the Creditors" in my Chapter 7 bankruptcy proceeding where the US Office of the Trustee questions Debtors under oath about their finances & request for discharge. Apple, of course, sent one of their Big Law whistleblower defense counsel on my case to watch.

I filed my Opposition to the City of Santa Clara's Motion to Dismiss & argued the City does have to comply with federal env laws & basic public safety law/policy, & this exact city's ongoing failure to do so is why these exact laws exist. In the Citizen Suit over Apple's skunkworks fab (dumping toxic waste into homes & playgrounds), the city of Santa Clara filed a motion asking to be removed, saying their fire dept can't be held accountable for failing to enforce public safety laws or for violating federal env laws. I beg to differ.

Last week, now facing the environmental Citizen Suit, city of Santa Clara finally released additional PRA records about Apple's secret fab. Its not great. Santa Clara withheld records for years concealing multiple chlorine & HCL gas leaks, broken fire/gas alarms, & hydrogen fluoride chemical burns.

Engine 98 responded code 3 to the address above for a high gas alarm and arrived without
incident. Upon arrival we met with facilities personnel who took us to the gas alarm
monitoring system which showed a momentary spike of Chlorine. The current reading
upon our arrival was 0ppm. The facility Emergency Response Team donned PPE and
appropriate monitors for entry to the room where the alarm originated. Engine 98 crew
donned PPE and acted as the backup team. The Emergency Response Team made entry
and found zero readings on their monitoring equipment which confirmed the 0ppm on the
alarm monitoring system. It was determined that there was no emergency. Engine 98
cleared the scene.

E99B was dispatched on a Bravo-level medical call for report of a Hazmat exposure at
location indicated in District 9. E99 PAR3/0 Carter, Poloni, Willis. No delays encountered
in turnout or enroute. Arrived on the scene of a local R&D building, met curbside by
security, and directed into front lobby entrance and ERT control room. Crew was met on
arrival with MSDS for product involved and other pertinent information about the
exposure. Pt. was a 29 y.o. M found sitting upright in an office chair alert/awake and
breathing, rubbing antidote on his R forearm secondary to a dermal exposure to approx. 2
mL of "spent" HF approx. 15 mins PTA. Per site emergency procedures, the ERT had
rinsed the affected area in an emergency shower for 10 mins. and then the pt. topically
applied (x2) tubes of calcium gluconate antidode per first aid instructions in MSDS. Per
site protocol the pt. was then considered decontaminated and was moved from the lab to
the location found. Pt. was not complaining of pain nor symptomatic at time of contact.
E99 crew rendered ALS assessment and care to the pt. XSCA M16R arrived on the scene
and was updated as to the material of concern, the route of exposure, and the
decontamination/antidote administered thusfar by the site (County event #0133). E99 CAPT and XSCA paramedic made face-to-face and agreed that satisfactory decon had
occured and on an appropriate destination. VMC was chosen as the county tox-hospital.
In addition to completing medical charting, E99 crew completed a "Patient
Decontamination Survey Sheet for Transport to Hospital" and provided it to M16R for
transport w/ the patient in addition to a copy of the product MSDS sheet in accordance w/
XSC EMS Policy #610 - 'Hazardous Materials Incidents - EMS Response and Transport.'

At 2121 hours on Friday December 8, 2023 we were dispatched to an unintentional
detector activation. Two units were assigned to this incident. Four personnel responded

At 0737 hours on Thursday May 30, 2024 we were dispatched to an EMS call. One unit
was assigned to this incident. Three personnel responded. We arrived on scene at 0743
hours and cleared at 0755 hours. The incident occurred at 3250 SCOTT Bl, SANTA
CLARA. The local station is 09. The general description of this property is manufacturing,
processing. The primary task(s) performed at the scene by responding personnel was to
provide basic life support (BLS). No mutual or automatic aid was given or received.
Alarm number 2404731 has been assigned to this incident.
Engine 99 were dispatched on this call code 3. We arrived on scene and met with the
patient. The chief complaint was dizziness. PT was found outside with staff. PT was
exposed to HCL gas and was outside for fresh air decon. Vital signs and medical history
were taken and recorded. A physical survey of the patient was made. County Ambulance
arrived on scene and was apprised of the patient's condition. BLS care was provided by a
EMT on Engine 99. The patient was offered transport to a hospital by ambulance and
chose to refuse it. The SCFD Refusal of Service Information Sheet was explained to the
patient in detail. The patient understands that the condition they have may get worse and
that by refusing transport could result in a more serious condition including death. The
patient made the decision to sign the form (electronic version) and again refuse the offer
for transport to a hospital. A witness also signed the form. See electronic copy of form.
County Ambulance was cancelled. For specific details regarding patient care, refer to the
Pre-Hospital Care Report written by DE Flournoy. All times approximate. Report by

In 1986, there was a chlorine gas leak at the HP fab in Cupertino injuring multiple employees. OSHA defended HP & claimed chlorine gas isn't harmful generally (?) & said OSHA only inspects if at least 5 employees are "seriously injured." The federal government shutdown exemption is generally: “emergencies involving the safety of human life or the protection of property."

So, apparently the NLRB thinks that US workers getting more/better labor rights is literally a "Property Rights Emergency." That sounds right.

During the shutdown, the US National Labor Relations Board won't let workers report violations of federal labor laws or file appeals. Yet, somehow, a few days ago, the NLRB found enough $ to sue the state of California because California enacted labor laws that threaten NLRB's bureaucratic monopoly.

Gavin Newsom last month, gives workers the ability to petition the California Public Employment Relations Board to take up their case in the event the National Labor Relations Board fails to respond. The NLRB is challenging the law in court, arguing it usurps its authority “by attempting to regulate areas explicitly reserved for federal oversight.” The National Labor Relations Board has sued California to block a law that empowers a state agency to oversee some private-sector labor disputes and union elections. Gov. Gavin Newsom signed Assembly Bill 288 into law last month in response to the Trump administration’s hampering of federal regulators. It gives the state’s Public Employment Relations Board the ability to step in and oversee union elections, charges of workplace retaliation and other issues in the event the federal labor board is unable, or declines, to decide cases. Apparently US courts ran out of funding on Friday & are now just 'making it work' with some of the most critical legal issues in the nation. Courts have finite resources (money, staff, etc.), & this shows how nonsense wasteful defense tactics can harm everyone.

Judiciary Funding Runs Out; Only Limited Operations to Continue

The judicial branch announced that beginning on Monday, Oct. 20, it will no longer have funding to sustain full, paid operations. Until the ongoing lapse in government funding is resolved, federal courts will maintain limited operations necessary to perform the Judiciary’s constitutional functions.

Federal judges will continue to serve, in accordance with the Constitution, but court staff may only perform certain excepted activities permitted under the Anti-Deficiency Act.

Examples of excepted work include activities necessary to perform constitutional functions under Article III, activities necessary for the safety of human life and protection of property, and activities otherwise authorized by federal law. Excepted work will be performed without pay during the funding lapse. Staff members not performing excepted work will be placed on furlough.

Each appellate, district, and bankruptcy court will make operational decisions regarding how its cases and probation and pretrial supervision will be conducted during the funding lapse. Each court and federal defender’s office will determine the staffing resources necessary to support such work.

For the non-legal eagles, there is a complex area of law about gov liability for gov agency decisions regarding compliance & enforcement issues, but most of the law focuses on tort liability if the gov makes a mistake. Its fairly clear that city gov's can't violate federal env laws or commit crimes.

Silicon Valley was probably the first place where I was clearly autistic at work but mostly wasn't judged about it (but they did judge on plenty of other stuff). It was a quiet deal: "I'll become a neoliberal shill if I get the funding, credibility, & upward mobility autistics normally can't get."

There seems to be a lot of ASD folks working in tech & engineering, & it felt normalized & accepted. This is still strange to me because while skillsets match (logic, pattern identification, etc), typical ASD behavior/views do not align with Silicon Valley cliques, "loyalty", or social hierarchies.
