Maybe I misunderstand you but one possibility is changing boundary conditions, >= to > for example.

The test should fail though if it’s properly testing the boundary (assuming the prod code hasn’t changed yet).

Of course every human has personal views, that's not the important thing, the important thing is that when performing their function as a judge they can be demonstrably neutral.

If they aren't, there should be recourse.
