Do you think this indictment is sufficient? It alleges fraud from 2020-2024 even though any rider limitation is max 1 year; doesn’t show dates the property was rented, nor does it state that no consent to rent in that year one was sought/obtained by Ms James. Seems to lack particularity at minimum.

This is a much better article from 5 days ago when Noem first made this story up. It points out that NO evidence or intelligence backs this up and interviewed a cartel expert who says this is extremely unlikely. This was a cover story DHS crafted after they shot a woman in Chicago this weekend.

That’s basically what Pete Davidson said. Someone asked him how he in particular could do this since his father died in 9-11 and he said once he saw the amount he had no problem saying he’d go. I assume he’s already rich but obviously not rich enough for his likings

I’m an ERISA attorney so not sure about whether fraud needs to be pled with specificity in an indictment like it does in a civil complaint.

If so, I don’t see how this passes muster; it doesn’t say the dates the home was rented; shouldn’t the indictment have to allege the rental began in year 1?

lol yes I understand that, I meant the indictment is intentionally misleading as it accuses her of committing a fraudulent act from August 2020 through “at least January 2024” when at most it could only have been from August 2020-July 2021. Para 6 also fails to reference the one year limitation.

One last note: Even before the revision, Fannie Mae said it was unaware of any case where just violating the Second-Home Rider triggered a foreclosure.

Even if she rented it from Day 1, she has been MASSIVELY overcharged: 2 counts each carry up to 30 year sentence, $1M fine, & property forfeiture.
