Those “other factors” are supposed to be based on harm-reduction. Apparently it’s harmful to the administration to follow the laws as they’re written.

Amy Coney Barrett defends heavy use of the shadow docket: "If we wrote a long opinion, it might give the impression that we have finally resolved the issue, and in none of these cases have we finally resolved the issue."

I know that this is not how it mentions are usually used, but I very much trust and respect the ladies of @strictscrutiny.bsky.social and I wonder if any of them have insight on this.

My question is: If the 15th Amendment bars denying votes based on previous conditions of servitude, and the 13th Amendment allows enslavement as punishment for crime— seemingly defining enslavement as incarceration—how can post-prison disenfranchisement be consistent with textualism as a principle?
mistersundae.bsky.social
I’m having a hard time getting my hands around the logic of this disenfranchisement on a textual level (probably because I’m not a lawyer)
mistersundae.bsky.social
I think that it’s reasonable to conclude that some of the judges and scholars ruling and advocating in favor of this disenfranchisement are textualists.

I am studying for a conversation that I’m having with a former colleague of mine for a podcast that we’re doing and I have a legit legal question.

There are a number of states that engage in voter disenfranchisement of formally incarcerated people.

Very frequently with mine lol

People who talk on speaker phone in public are a different breed, I fear.

My client just sent me an AI logo to use and I’m about to combust….

respectfully, @jaketapper.bsky.social definitely deserves the criticism he’s received about this phone interview with Trump.

As someone who has positioned themselves as an expert on presidential decline, it might be advisable to NOT provide cover for one whose mind is clearly rapidly deteriorating

If you were to say“this is not what I paid for” I could fairly tell you that you did pay for this….. You were just hoping that the reviews were wrong. They weren’t.

But instead of a $70 game that you could return we have four years of a maniac in the White House. Hope that helps!
mistersundae.bsky.social
This framing always makes me chuckle. Imagine waiting on a new game to come out. You see a lot of reviews come out saying that the game sucks. You decide to ignore those reviews and you spend $70 on it only to find out that it sucks.

“I voted for none of this."

Prominent influencers, including Theo Von, Joe Rogan, and Andrew Schulz, are starting to distance themselves from the president they helped propel to the White House.

Now, as I’m listening to the episode, I see why 🤣

So, I was in my car this morning when I asked Siri to play the @strictscrutiny.bsky.social of course, Siri ignored me, as he normally does, and did his own thing. But something tells me that @leahlitman.bsky.social would not mind what it decided to play instead. #HappyMonday

Season 2’s style is a LOT better…

Finally got around to watching The Four Knights of the Apocalypse. Still not a fan of the style, but the storyline is likable

DoorDash has been dropping off Mexican food at a white supremacist house……. On a Sunday.

Help.

The current occupant of the White House is actively….. actively……. Musing about inflicting more unnecessary pain on people who are already suffering.

This man is holding people hostage so that he doesn’t have to reduce people’s healthcare costs….
mistersundae.bsky.social
I want us to marinate in something real quick. Typically, if there is a government shut down, politicians would try to reduce harm as much as possible.

They don’t want people to suffer. They don’t want people to lose their livelihoods.

Sticking your middle finger out at people while you’re driving is insane behavior. One day yall gonna meet somebody that’s gonna snap….and then what??

Just finished reading @mehdirhasan.bsky.social’s amazing book “Win Every Argument”. I suggest you do the same. It’s succinct, accessible, and beautifully written. I feel like I now have the tools to improve as an educator, as a political activist, and as an opinionated motor-mouth.

I don’t think you’ll understand how shockingly archaic and fascist this is. Everything that the right has projected onto liberals for a decade…. They are now actively pursuing. This is a clean, cut violation of the first amendment.

And it will not stop here

Finally got around to starting @mehdirhasan.bsky.social ‘s “Win Every Argument” and the fact that he started the first chapter with a quote from a design expert…… this book is already amazing. I don’t even have to finish it to know that it’s about to hit. But I will finish it. Thoughts pending.
