A so-called Memorandum of Understanding was signed for cooperation between Italy and Libya. If it is not revoked by 2 November 2025, it will be automatically extended for another 3 years. Starting tomorrow, days of action against the renewal of the agreement will begin in Rome.

Two others were seriously injured. The refugees have since been able to disembark in Pozzallo, Italy.

Although Alarm Phone and the Italian sea rescue organisation Mediterranea Saving Humans informed the Italian authorities directly, it took 24 hours after the shooting for the rescue to begin.

CN Armed violence
Once again, the so-called Libyan coast guard has fired on refugees in the Mediterranean. Alarm Phone reported that the attack took place on Sunday in the Maltese search and rescue zone. One person is currently in a coma after being hit in the head by a bullet.

The detention of civilian rescue ships is pure harassment and life-threatening! The Piantedosi decree, which provides the basis for the detentions, must finally be abolished! Sea rescue is a duty!

The court made it clear that the crew had sailed to Trapani to protect the rescued people, who were in a particularly vulnerable and fragile condition. The ship should be released as soon as possible so that Mediterranea can continue its life-saving work.

The court in Trapani has lifted the detention of the civilian sea rescue ship Mediterranea. The ship is thus complying with the appeal lodged against the 60-day detention and the €10,000 fine.

Two other boats could not be found despite emergency calls.
The politically organised delay in disembarking refugees deliberately prolongs their suffering. In addition, the authorities are preventing the ships from rescuing more people!

On Sunday night, Sea-Watch 5 rescued 79 people. The rescued people were assigned to the port of La Spezia, which is why they will not be safe until Friday. No one should have to wait days for protection after being rescued.

According to those who were rescued, seven people had already drowned. After the ship was initially assigned to Bari for disembarkation, it was finally able to bring the people ashore in Porto Empedocle on Sunday and prepare for the next rescue.

SOS Humanity's Humanity 1 also rescued 41 people in distress over the weekend who had been in an overcrowded rubber dinghy on the open sea for more than four days. For two people, the rescue came too late and they died on the rescue ship.

Systematic impoverishment
The complete withdrawal of benefits contradicts German law and also the EU Reception
Directive (Art. 21), which prescribes a minimum standard. It also contradicts Art. 18 (1) of the
Asylum and Management Regulation.
Particularly drastic is the partial denial of medical care. According to Art. 22 of the directive,
health care must not be completely denied, especially not to minors or vulnerable persons. The
GEAS draft ignores these obligations.

Asylum seekers should be locked up.
The GEAS Amendment Act will in future allow those seeking protection to be locked up at night
in the new so-called secondary migration centers. This ban on moving freely at night is based on
the blanket assumption that there is a risk of flight and effectively transforms reception facilities
into closed centers, even without locked doors.
Pro Asyl (2025) describes this as deprivation of liberty. The measure thus also touches on the
decision of the Federal Constitutional Court of November 19, 2021; psychological coercion can
already be considered an infringement of fundamental rights. (cf. BVerfG, decision 1 BvR
781/21). The conditions are controversial: even a violation of the ban on leaving or participation
in border procedures may be sufficient (cf. Pro Asyl 2025).

Anyone who “violates conditions” or “disturbs the peace” may suffer benefit cuts or even
complete withdrawal of benefits (§ 1a (7/8) AsylbLG-E). In addition, the current draft law
provides that asylum seekers will no longer be granted work permits after their application has
been rejected, even if they file an appeal in time and continue to reside legally in Germany. Even (alleged) violations of cooperation obligations are punishable by blanket work bans. Both
regulations violate EU law and the German Basic Law, lead to exclusions from the labor market
that can last for years, and, due to their lack of clarity, create considerable scope for arbitrary
administrative decisions (cf. Refugee Council of Saxony 2025).

The law significantly tightens the Asylum Seekers Benefits Act.
Since 2024, Dublin cases have been threatened with complete exclusion from benefits, even
though courts have repeatedly criticized these regulations as unconstitutional (see Pro Asyl
2025). Furthermore, the “voluntary departure” mechanism is becoming a farce:
• Health restrictions
• Lack of documents or traumatic experiences are ignored, while support services are

With the cabinet decision of September 3, 2025, and its transfer to the parliamentary process,
the implementation of the new Common European Asylum System (CEAS) begins, which will be
transposed into national law from summer 2026 (cf. Pro Asyl 2025).
There is a threat of a radical curtailment of individual asylum rights and further systematic
exclusion.
The GEAS draft reveals the core of its approach: not protection, but defense. Asylum seekers are
to be subjected to a procedure as quickly as possible and, if possible, outside the EU's borders,
even if they face persecution in their countries of origin or transit. (cf. Pro Asyl 2025)

Even more camps
With § 44 (1a) AsylG-E, the federal government is introducing so-called “reception facilities for
carrying out secondary migration procedures.” In doing so, it is even going beyond the EU
requirements.
These centers are to be set up as soon as the law comes into force, well ahead of the EU
regulations, which will not apply until June 2026.
The federal states will decide whether and where such centers will be established. Baden-
Württemberg and Lower Saxony are planning the first locations. (cf. Pro Asyl 2025)
The planned facilities are intended for people in the Dublin procedure and those who have
already been recognized. Adults are to be accommodated for up to 24 months and families with
children for up to 12 months, six months longer than in regular facilities.

Children do not belong in detention: neither directly nor indirectly.
Deprivation of liberty in the context of migration is contrary to the best interests of the child and
must be prohibited by law. Detention-like facilities are no place for children. What matters is
their lived reality: isolation, control, fear.
Protection needs must be identified early and bindingly in order to ensure humane
accommodation for children and families. Education cannot wait: refugee children need access
to school and education from day one.
