That said, a Speaker does not have unconstrained power to refuse indefinitely to swear in a duly elected Member, especially if that refusal thwarts a district’s representation. Such a refusal would collide with constitutional and statutory expectations, precedent, and democratic norms.

The statutory regime (2 U.S.C. § 25) and House practice fill in those gaps, by assigning the responsibility to the Speaker and allowing for later oath-taking.

Johnson refuses to swear in AZ Democratic Representative. The Constitution mandates that Representatives must take an oath (or affirmation) to support the Constitution, but it does not prescribe exactly how, when, or by whom that must occur.
