Roger is correct the hearing was remarkable: Govt efforts to conceal their continuing bad faith towards Abrego were comprehensively dismantled by his assiduous lawyers.

Have I got this right. Basically ICE/ERO have twiddled thumbs since July, had occasional conversations that didn’t go anywhere, didn’t keep a file, yet Govt position is “Abrego cd be removed in 72 hours to Eswatini/Ghana/Uganda” 🙄

It’s not about what his duties ARE, #fn-3 is about A COMFORT ZONE ambit of immunity/impunity protecting the Presidency from having the robust exercise of its powers BEING QUESTIONED/EXAMINED—so Presidents are not hampered by the CONCERN of drawing limit of powers in the wrong place. #fn-3 = shit!!

This is exactly the dilemma SCOTUS created for itself. #fn-3 is essentially exclusionary rule protecting the Presidency from embarrassment of evidence of misconduct being ‘published’ in court proceedings.
A possible remedy is to have in camera procedures for such matters, like CIPA.

So whatever fn3 May mean it cannot be used to defeat a defendant’s constitutional rights.

And IF fn3 has an application to such a case as this, to prevent embarrassment of the Presidency by exposing in court complicity between the President and the DOJ

Then the remedy is for DOJ to dismiss!!!
