What Senator Cotton says here would be a bad defense for the Germans convicted in WWI and WWII war crimes trials -- including for firing on shipwrecked in fully operational lifeboats.

This line of response hurts the US and US servicemembers. It will cause long-term damage unless we get this right.
WELKER: Lawmakers say the 2 men appeared to raise their arms potentially to surrender. Why did Admiral Bradley interpret these actions as anything other than them trying to survive?

TOM COTTON: They were sitting or standing on top of a capsized boat. They weren't floating helplessly in the water

and judge pan gets at what i was gesturing towards earlier today: that this idea that the purpose of the executive branch is to effectuate the political agenda of the president is extra-constitutional. it has no basis in the text or the history for that matter!

Hi. History teacher here. I've been teaching most of what's in Burns's documentary for about 2 decades, including the invasion of Canada. If much of the information Burns reveals is a surprise to people, it could be less about what teachers are teaching and more about what students are remembering.

Dems in Congress should start demanding the list of names of all ICE “agents”. These people seem to walk more carefully when they know consequences may be around the corner.

It's worth noting that the laws of war don't just cover declared wars, but all conditions of "belligerence", declared or not.

So a killing could be BOTH a normal crime (because no legit authorization for force exists) AND a war crime (because it violates the int'l rules governing warlike acts).

Of course the right's position is "ALL of Trump's orders are BY DEFINITION legal." They don't care about the details of the boat bombings, deportations, etc.

Crucial: We must fight that false belief that being President makes all his orders legal.
The correct answer to MAGA outrage over the Dem video is this: Are you effing kidding me? Of course it's reasonable to warn that Trump might be giving illegal orders.

The evidence is strong that he actually is giving illegal orders! I went through that evidence here:

Is Trump Giving Illegal Orders? Dems Just Blew That Question Wide Open
From the boat bombings to deportations to prosecutions, the evidence mounts. And the speaker of the House could get to the bottom of it if he wanted to. Yeah, right.

It’s not a free speech question. It’s about an authoritarian calling for his political opposition in an elected branch of government to be prosecuted for opposing him. It’s a constitutional crisis.
