Easy answer: Mario continuity ain't shit half the time. I don't think anyone should really worry about story implications behind King Boo's presence and design in a game just meant to be centered around racing with iconic Mario characters.

Easy answer: Mario continuity ain't shit half the time. I don't think anyone should really worry about story implications behind King Boo's presence and design in a game just meant to be centered around racing with iconic Mario characters.

First and foremost, he is the only King of Boos there is. That argument that there's a separate King Boo in Mario Kart/Party I feel like only exists cause people aren't satisfied with that design for him. Why does he look different, why is he out of the painting?
