The legislator ignores its own Constitutional Court: same-sex marriages concluded abroad are still not recognized As we have already reported , the Constitutional Court ruled in June this year that there is a violation of the fundamental law by omission due to the legislator's failure to ensure domestic recognition of same-sex marriages concluded abroad as registered partnerships. The Parliament was supposed to adopt the legislation ensuring this by 31 October 2025, but – as we have come to expect – it failed to meet this obligation. Same-sex couples who marry abroad are still considered non-existent by Hungarian authorities, so they are still considered to be ordinary partners under Hungarian law, with much more limited rights and obligations than marriage and registered partnerships. Some everyday disadvantages: Hungarian law does not recognize the community of property between them, in the event of the death of one of them, the other is not the legal heir, and if one of the couple is not a Hungarian citizen, the preferential naturalization and immigration rules do not apply either. In other words, the legal institution that provides the full spectrum of rights in one state is reduced to the weakest form of partnership in Hungary. Two clients of Háttér Társaság filed a constitutional complaint after unsuccessfully attempting to have their marriage concluded abroad recognized as a registered partnership capable of remedying at least the disadvantages referred to above. In their submissions, they argued that the refusal to recognize the marriage violated their right to human dignity and respect for private and family life, as protected by the Fundamental Law. This, they argued, was also contrary to the practice of the European Court of Human Rights (ECHR) and the Court of Justice of the European Union.

Empirical research of Austria, Germany, Hungary & USA politicians’ illiberal policy frames:

“Narratives show no relation to markers of the underlying policy crises, which points to a political strategy based on continued fear-mongering [e.g on immigration] rather than crisis exploitation.”
Our findings suggest that the usage of illiberal political frames does not closely track the pertinent policy crisis metrics, such as the number of asylum seekers (for migration) or casualties (for COVID-19). Giorgia Meloni, whose political roots are in Italy’s postwar neo-fascist movement, became prime minister three years ago. Italy’s centre left remains deeply wary of Meloni. As prime minister, she has taken strongly conservative positions on immigration and social issues — but she has avoided the hardline nationalism and erosion of democratic institutions characteristic of Orbán or Donald Trump. Meloni has also so far escaped the bitter anti-incumbent backlash visible in Britain and France. She looks likely to become only the second Italian prime minister since the second world war to serve a full five-year term. In doing so, Meloni points to an unsettling possibility for European politics.
