I think you might be confusing the contractual relationship between the university as institution and the student, which is recognized, but a syllabus or rubric absolutely isn't the instrument that makes that relationship contractual. You might find this NIH peer reviewed article enlightening:

Hey I see what you're saying but they absolutely are not contracts. Contracts have to meet some basic criteria including consideration, which no syllabus (much less a rubric) could provide. I would repeat my request for any relevant case law backing up OP's first amendment assertions.

The problem isn't whether the essay merited a 0 or a 65, and acting like you're the adult in the room speaking truth to power because you think that a zero isn't /technically/ the exact score she deserves according to the prompt is missing the point so willfully as to be itself transphobic
