Do these federal prosecutors understand that an "indictment" is a charging *document*? Like, the actual pages that formally charge someone with a crime?
MR. LEMONS: Thank you, Your Honor. Your Honor, the government's position and understanding of the way things proceeded is that there was only one indictment presented and that the -- I guess what Your Honor is referring to is the new indictment was, in fact, not a new indictment. The grand jury, through the entire course of events, had said, and was maintained and consistent, that they only no true billed Count One and they true billed Counts Two and Three, and that the edits to the indictment were only to reflect the voting of the grand jury and were not an actual new indictment in any way whatsoever.

Fannie Mae watchdogs who were removed from their jobs had been probing if Trump appointee Bill Pulte had improperly obtained mortgage records of key Democratic officials, including New York Attorney General Letitia James, according to people familiar with the matter. Fannie’s ethics and investigations group had received internal complaints alleging senior officials had improperly directed staff to access the mortgage documents of James and others, according to the people. The Fannie investigators were probing to find out who had made the orders, whether Pulte had the authority to seek the documents and whether or not they had followed proper procedure, the people said. That group elevated the probe about the James documents to the more senior Office of Inspector General for the Federal Housing Finance Agency, the agency that oversees Fannie Mae and Freddie Mac and that Pulte heads, the people said. The acting inspector general then passed the report to the U.S. attorney’s office in eastern Virginia, some of the people said.

The situation has no parallel in American history, as Mr. Trump, a presidential candidate, was pursued by federal law enforcement and eventually won the election, taking over the very government that must now review his claims. Judge Graber, who is no firebrand, wrote quite a dissent—encouraging en banc review and some patience on the part of the public:
We have come to expect a dose of political theater in the political branches, drama designed to rally the base or to rile or intimidate political opponents. We also may expect there a measure of bending sometimes breaking the truth. By design of the Founders, the judicial branch stands apart. We rule on facts, not on supposition or conjecture, and certainly not on fabrication or propaganda. I urge my colleagues on this court to act swiftly to vacate the majority's order before the illegal deployment of troops under false pretenses can occur. Above all, I ask those who are watching this case unfold to retain faith in our judicial system for just a little longer.
