It's an evaluation of the reasonableness of the client in relying on the attorney. And that's usually within the judge's discretion.

No, you waive privilege if you intend to assert advice of counsel as a defense.
It's more "This was a complex area that we would expect the average lay person to rely on counsel to guide them through..." and if it turns out your counsel fucked up royally it wouldn't be fair to pin that on the client

I cannot stress enough that people need to come to terms with the fact that these people are going to do shitty things and to a large degree are GOING TO GET AWAY WITH IT because of the pardon power.
Focus on building a NEW system that prevents this from happening again IN THE FUTURE.

It's more or less a play on the "they didn't act like a [victim, witness] etc" stereotype. But with the added shittyness of "and we're going to do this based solely on how their voice sounded and without anything else"
