A warning about the looming threat of public health law vacuums from me and my wonderful colleague @profgoldberg.bsky.social.

See also SCOTUS decisionmaking on remedies - specifically cases that limited the types of damages available when plaintiffs privately enforce their rights. Cummings v. Premier Rehab Keller is a good recent example, as @jasmineeharris.bsky.social & I discussed here: aulawreview.org/blog/the-dis...

Lurking under the surface of the 6–3 majority is a split over how to evaluate laws that indisputably discriminate against transgender people. Barrett, Thomas, and Alito say that anti-trans discrimination is not subject to heightened scrutiny. Roberts, Kavanaugh, and Gorsuch don't say either way.
Roberts writes for the conservative supermajority to uphold Tennessee's ban on gender-affirming care for minors. He says the law does not discriminate on the basis of sex OR transgender status, and says this issue must be left to the democratic process. www.supremecourt.gov/opinions/24p...

My guest essay for @nytimes.com about Adriana Smith. This situation is a tragedy from top to bottom, and there is so much complexity that can't be teased out in so few words. May she and the family left behind find peace soon.
