A soldier who thinks an order is illegal must refuse it, but they should first seek legal advice from a military lawyer (Judge Advocate) if unsure. They can also use other channels to report concerns, such as an Inspector General complaint or the "redress of grievance" process.

At the end of WWII, we tried German soldiers and officer who committed massacres, war crimes, atrocities and crimes against humanity. There defense, they were merely following their county's leader, Adolf Hitler's, ORDERS. The UN and Allies ruled that was NOT A DEFENSE to obeying illegal orders.
