There's a reason we lawyers that a grand jury would indict a ham sandwich. If a guy isn't even indicted, do you know what that makes him?

INNOCENT.

With very few exceptions, there is generally only one reason that a prosecutor is unable to obtain an indictment against someone:

They don't want to.

Loevy plays a video of a woman's arrest. Hewson says the woman was "assaultive" because she kicked a can of tear gas that had been deployed.

Loevy: "When you tear gas somebody … and they try to kick the tear gas canister away from them, that's assaulting?"

Says assault requires a “reasonable fear of immediate bodily harm,” and none exists given agent’s long-sleeve shirt, long pants, boots, gloves and ballistic vest that is created to “keep you safe from military rifle fire” and so is “definitely going to keep you safe from a sandwich.”

Federal prosecutor, in his rebuttal, is in the tough position of hoping the jury forgets about the hundreds of MAGA folks pardoned by Donald Trump for vicious assaults on law enforcement on Jan. 6 and takes a sandwich case seriously.
