Absolutely yes.
All games need a range of difficulties from "I can't die" to "I'm fighting God" and also allow individual aspects of difficulty to be tweaked. Making enemies bullet sponges whilst your character is made of paper is boring.

No, that a company policy is trumped by the laws of a country that a company is operating in.

IGNs response to my dispute was irrelevant to what happened in the first place; that they screened up and didn't accept responsibility.

Basically this, yeah.
All they had to do was contact the courier and ask for more information.

A similar situation with a courier with a package from Microsoft. With some liaison with the courier they were able to locate the package and let me know where it was (right house number, wrong street)

Shipping policies don't outweigh laws of a country. Hence why I got my money back, and when IGN disputed that action they got told to politely fuck off.

Yeah where I live it's the sellers responsibility to get the item to the purchaser. If the courier screws up it's the sellers responsibility to sort out the problem with the courier.
