For sure it cannot invalidate a law. But can an EO legally empower a department to act in a way that supersedes or acts alongside it? For example, the EO could say “the legal name is still DoD but in practice we will call it the War Department as an in-kind nomenclature exchange”

Are you specifically referring to Clause 14, the authority “to make rules for the government and regulation of land and naval forces”? Does that invalidate any executive authority to change the name of anything in the military?

Kind of. If Congress reserves the authority to formally name a department, then it means the President inherently cannot formally do so. If he then directs his entire administration to call it the War Department anyways, then it’s just a temporary nomenclature change, which any POTUS can reverse

I mean, let’s imagine the Air Force had an aircraft with a legal designation. But in word and deed, the USAF routinely called it by a different name. Is that illegal? Immoral? Is the Viper demo team a hotbed of treason?

To be fair, I’m long retired now and never quibbled with the name of the Department. Seems an odd hill for the Admin to fight over, but pols have battled over less I suppose

Is it an unlawful order or a dispute between the balance of powers? I’m not a lawyer. But it seems like an issue of nomenclature doesn’t rise to the level of a moral duty to disobey an order. Does the Constitution give Congress the authority to set/change the name of the Army & Navy departments?

It’s an interesting case. If the President directs the military to do something that is contrary to an Act of Congress (renaming the department) but the action itself is not inherently immoral, what is the ethical response? Should senior officers inject themselves into a balance of powers dispute?
