ร่างแก้ พ.ร.บ.คุ้มครองแรงงาน ลด ชม.ทำงาน-เพิ่มวันหยุด จ่อเข้าประชุมสภา วาระ 2-3 สมัยหน้า Pazzle Wed, 2025-10-29 - 21:38 สส.พรรคประชาชน แถลงกฎหมายคุ้มครองแรงงาน “ลดชั่วโมงทำงาน-เพิ่มวันหยุดพักผ่อน” ผ่านการพิจารณาชั้น กมธ. เสร็จแล้ว จ่อเข้าสภาวาระ 2 และวาระ3 ในสมัยประชุมหน้า สส.ประชาชน หวังทุกพรรค-สว. จะสนับสนุน ยกระดับคุณภาพชีวิตคนทำงานทั่วประเทศให้มีกำลังแรงกายแรงใจในการทำงานมากขึ้น และจะส่งผลให้การผลิตของนายจ้างเติบโตขึ้นด้วยเช่นกัน ย้ำกฎหมายฉบับนี้คือการคืนความปกติ คืนสิ่งที่ควรจะเป็นให้กับคนทำงานทั้งประเทศ   29 ต.ค. 2568 ที่รัฐสภา สส.พรรคประชาชน ในคณะกรรมาธิการวิสามัญพิจารณาร่าง พ.ร.บ.คุ้มครองแรงงาน ฉบับแรงงานมีเวลาพักผ่อน ซึ่งเสนอโดย จรัส คุ้มไข่น้ำ สส.ชลบุรี เขต 8 พรรคประชาชน ร่วมแถลงข่าวความคืบหน้าการพิจารณากฎหมาย โดยจรัสกล่าวว่า เมื่อวานนี้ (28 ต.ค. 2568) คณะกรรมาธิการฯ ได้ประชุมร่วมกันเป็นครั้งที่ 8 แต่ละฝ่ายได้แลกเปลี่ยนความคิดเห็นอย่างต่อเนื่องและรอบด้าน ที่ประชุมมีมติแก้ไขสาระสำคัญของร่างฉบับนี้ ดังนี้ (1) แก้ไขลดชั่วโมงการทำงาน จากเดิม 48 ชั่วโมงต่อสัปดาห์ ลงเหลือ 40 ชั่วโมงต่อสัปดาห์ เว้นแต่งานเสี่ยงอันตรายจะไม่เกิน 35 ชั่วโมง เป็นไปตามร่างที่พรรคประชาชนเสนอ (2) แก้ไขกำหนดให้นายจ้างจัดให้ลูกจ้างมีวันหยุดประจำสัปดาห์ จากเดิมสัปดาห์หนึ่งไม่น้อยกว่า 1 วัน โดยวันหยุดประจำสัปดาห์ต้องมีระยะห่างกันไม่เกิน 5 วัน แก้ไขเพิ่มเป็นสัปดาห์หนึ่งไม่น้อยกว่า 2 วัน โดยวันหยุดประจำสัปดาห์ต้องมีระยะห่างกันไม่เกิน 5 วัน (3) แก้ไขกำหนดระยะเวลาการให้สิทธิลูกจ้างหยุดพักผ่อนประจำปี จากเดิมกำหนดให้ลูกจ้างซึ่งทำงานติดต่อกันมาแล้วครบ 1 ปี จึงมีสิทธิหยุดพักผ่อนประจำปีได้ไม่น้อยกว่า 6 วันทำงานต่อปี แก้ไขเป็นให้ลูกจ้างซึ่งทำงานติดต่อกันมาแล้วครบ 180 วัน มีสิทธิหยุดพักผ่อนประจำปีได้ไม่น้อยกว่า 10 วันทำงานต่อปี ทั้งนี้ ในส่วนของวันบังคับใช้ พ.ร.บ. ฉบับนี้ จากเดิมได้เสนอให้มีผลบังคับใช้ภายใน 30 วันนับแต่วันที่ประกาศในราชกิจจานุเบกษาเป็นต้นไป แต่จากการประชุมเพื่อรับฟังความเห็นจากหลายภาคส่วนที่เกี่ยวข้อง เช่น กระทรวงแรงงาน ผู้แทนนายจ้างและผู้แทนลูกจ้าง คณะกรรมาธิการได้พิจารณาแล้วเห็นว่าควรแก้ไขให้มีผลบังคับใช้ภายใน 1 ปีนับแต่วันประกาศในราชกิจจานุเบกษาเป็นต้นไป เพื่อให้มีการรองรับและปรับตัวในการเตรียมความพร้อมสำหรับการเปลี่ยนผ่านที่เหมาะสมสำหรับนายจ้าง ลูกจ้าง และกระทรวงแรงงานต่อไป ด้าน เซีย จำปาทอง สส.บัญชีรายชื่อ สัดส่วนเครือข่ายผู้ใช่แรงงาน พรรคประชาชน กล่าวว่า กฎหมายฉบับนี้มีเจตจำนงเพื่อยกระดับคุณภาพชีวิตพี่น้องแรงงาน ให้คนทำงานทุกคนมีความมั่นคงในการทำงานมากขึ้น ซึ่งต้องขอบคุณกรรมาธิการทุกภาคส่วนที่ร่วมกันพิจารณาจนมีความคืบหน้า อย่างไรก็ตาม มีกฎหมายอีกหลายฉบับที่ต้องร่วมกันผลักดันต่อไป สำหรับร่างกฎหมายคุ้มครองแรงงานนี้ จะเข้าสู่วาระ 2-3 ในสมัยประชุมหน้า ต้องขอแรงสนับสนุนจาก สส. ทุกพรรคการเมืองในการร่วมผลักดันเพื่อไปสู่ชั้น สว. ต่อไป “การลดชั่วโมงทำงานจะทำให้พี่น้องแรงงานมีคุณภาพชีวิตที่ดีขึ้น มีสรรพกำลัง มีร่างกาย มีกำลังใจที่จะทำงานมากขึ้น เพื่อให้ผลผลิตของนายจ้างเติบโตขึ้นด้วยเช่นกัน” เซียกล่าว ขณะที่สหัสวัต คุ้มคง สส.พรรคประชาชน จ.ชลบุรี กล่าวว่า กฎหมายฉบับนี้เป็นมากกว่าเรื่องสิทธิแรงงาน แต่เกี่ยวข้องกับเศรษฐกิจและความมั่นคงของประเทศ นายจ้างจะได้แรงงานที่มีผลิตภาพมากขึ้น ความเสี่ยงในการเกิดอุบัติเหตุต่างๆ จากการทำงานจะน้อยลง แรงงานมีเวลาไปใช้จ่ายเงินมากขึ้น กฎหมายฉบับนี้จึงเป็นประโยชน์ต่อทุกฝ่าย เป็นการยืนยันเรื่องที่ทั่วโลกถกเถียงกันมานานแล้วว่าคุณภาพชีวิตของแรงงานควรอยู่ตรงไหน กฎหมายฉบับนี้คือการคืนความปกติ คืนสิ่งที่ควรจะเป็นให้กับคนทำงานทั้งประเทศ ดังนั้นไม่เห็นเหตุผลใดที่จะปฏิเสธกฎหมายนี้ จึงฝากประชาชนติดตามการลงมติทั้งในวาระ 2-3 และในชั้นวุฒิสภาด้วย   * ข่าว * การเมือง * แรงงาน * คุณภาพชีวิต * พรรคประชาชน * สหัสวัต คุ้มคง * เซีย จำปาทอง * การลดเวลาทำงาน * เพิ่มวันหยุด

The joint parliamentary meeting approved the People’s Party and Bhumjaithai Party charter amendment drafts in the first reading, while the Senate rejected the Pheu Thai draft. These amendments aim to establish mechanisms for rewriting the 2017 junta-drafted constitution. For a charter amendment draft to pass the first reading (principle approval stage), it must receive the approval of no less than half of the total members of both houses, or 345 votes, out of 690 active members of parliament (491 active MPs and 199 Senators).

Bhumjaithai's recruitment of MPs and the new government’s policy statement have raised questions about the party's commitment to dissolving the House before March 31 for a general election, according to Pheu Thai MP Jiraporn Sindhuprai. She also said that Prime Minister Anutin Charnvirakul is a suspect in a criminal case linked to alleged vote-rigging in the 2024 Senate selection process, highlighting public concern over the handling of these cases.

The public will have four decisions to make on general election day: which constituency MP to vote for, which party to choose for list-MPs, whether to support drafting a new charter, and whether to revoke the 2000 Thai–Cambodian MOU on land demarcation, said Deputy Prime Minister in charge of legal affairs Borwornsak Uwanno. If Prime Minister Anutin Charnvirakul dissolves the House of Representatives before March 31, as he indicated, the next general election could take place around March or April.

Democrat list-MP and former party leader Jurin Laksanawisit described the agreement between the People's Party and Bhumjaithai Party as an eccentric deal that produced a minority government with limited time to govern, overseeing a fiscal budget plan it did not formulate. He said that since the ruling government made this deal, it cannot complain about having limited time. He believes that Prime Minister Anutin Charnvirakul had already calculated that accepting the premiership under these conditions—including dissolving the House of Representatives within four months of coming into power—would be worth it.

The Bhumjaithai-led government must prioritize drafting a new constitution to fulfill its commitments under the agreement with the People's Party and to end Thailand’s cycle of coups and political instability, said People's Party leader Natthaphong Ruengpanyawut, the opposition leader, during the new government’s policy announcement in Parliament. Natthaphong noted that those born in the 1960s experienced a period when Thailand’s economy grew on average 9.7% annually, benefiting from global factors such as the Plaza Accord, which attracted substantial foreign investment and earned Thailand the title “Asia’s Fifth Tiger.” However, this generation has witnessed at least six coups.

Prime Minister Anutin Charnvirakul presented his government’s policy statement before a joint sitting of Parliament today, laying out urgent measures in five key areas. Anutin, also serving as Interior Minister, said his administration begins its term amid uncertainty, with limited time and resources, and as a minority government operating under a budget it did not draft. Prime Minister and Interior Minister Anutin Charnvirakul said the draft of government policies has been completed, covering society, the economy, and security. The framework and content are already finished, though some adjustments may be made after recent meetings with the Thai Bankers’ Association, the Thai Chamber of Commerce, the Federation of Thai Industries, and the public to better reflect their concerns.
