6/ European society is not a fixed object but a process with no utopic end. It is, to me, a conversation and a site for both deliberation and contestation.

A place that needs to resist narrowing but remain open to the conversations it is yet to have and *needs* to have.

5/ The methodological limitations of EU law and legal studies are known. These limitations further disconnect the scholarship from reality.

If we are going to meet this moment, closing spaces is not the answer. Opening, decentering, perspective and reconstruction based on empathy is.

4/ As the case was deliberated in the court, the far, far-right continued to gain new ground in the EU.

We must ask ourselves why this (unprecedented) development is happening. What are the people saying? Are they taken seriously? Are we reflecting on this in our (legal) scholarship?

3/ Opening the space to critically contend with the way EU law lives - on the ground - beyond narratives of exceptionalism of the law itself but excavating the ‘who’ ‘when’ ‘where’ and ‘why’ in EU law has never been a more important crucial enterprise.

2/ @silviasteininger.bsky.social and I problematise this in our paper on ‘In-/Exclusion in the European Society’ that uses critical methodological approaches as we, a German and a Maltese scholar, look at recent case law foregrounding marginality, liminality and Otherisation in the ES.

1/ As the ‘European society’ takes centre-stage following the C-769/22 pleadings before the court, it has never been more important to approach questions of who is and who is not seen in this European society and consequently in the law of the European society.
