They both know/knew how to appeal to a crowd. And that, I think, was the real problem in both cases -- the crowd.

No. They will lose the ability to afford health care -- a different thing.

And a thing that is less key to the people's future than losing their right to liberty through self government.

But perhaps that's too esoteric for the American people now?

Yes, and that to my mind is the central problem this government shutdown must address. Maybe "healthcare" is the way to approach it, but GOP concessions on that issue today mean nothing if they can be ignored tomorrow.

The follow-up question would be: would the court be improved if they did?

I think the problem is with the selection and confirmation processes. Especially the latter, which has become an embarrassment if not a political crime.
