I was under the same impression.

@ajlanes.bsky.social corrected me and she pointed me to the relevant part of The Equality Act, which does seem to say calendar days.

She is right. Except for recesses of more than four days, it is calendar days. (Equalitytt Act 2006 ss. 14(8) and 15(2) )

Apparently The Government asked the EHRC for the equality impact assessment and got it on Monday. Also Falkner says in the House of Lords that parliament only gets "40 calendar days" not 40 sitting days to consider the code when it is laid before parliament.

There was some news revealed. The Minister for Women and Equalities has asked the EHRC for more information about their draft code of practice (15:42:00 below).

Interesting the EHRC has written to the minister asking that they lay the new code before parliament and withdraw the 2011 code. Presumably the 2011 code is still in force and can be relied on as part of EqA 2006 s 15(4)(b).

Does the EHRC lawyer not understand how the GRA works?

This argument would render a GRC & GRA meaningless in all cases. It ignores the obvious fact that you can in principle establish most people's "certified sex" w/o breaching confidentially by looking at their (maybe amended) birth certificate.
