There’s a very disturbing pattern of trial court judges- those that spend days hearing and viewing evidence and who live in the effected states-deciding one way then appellate judges reading briefs deciding another. We need more trial judges and fewer institutional lawyers on appellate courts

The root problem here is that federal immigration laws are out of sync with a supermajority of public opinion. The only way to address this is to fix our immigration laws. This is a Congressional problem. So we must change Congress at the ballot box

OMG- a judge in the 9th circuit COA oral argument just said basically… I don’t know how any court can second guess how the President assesses the laws or facts…

Seems like 2 of the 3 judges are hostile to the District Courts injunction. If so expect the Guard in the city’s streets soon

This is a good Point. And using PPB as witnesses doesn’t mean you solely rely on them. So it’s not one or the other. And for sure many judges give testimony by sworn officers more weight

Judges should be pretty furious about this. Using a different states Guard units doesn't alter the Courts legal finding that under the statute, the President couldn't call in federal troops or the Guard. Using a different state's Guard doesn't change that finding.

Insane development. From a legal perspective it certainly violates the Judges Order. She found no statutory legal reason to have the Guard activated and deployed. Changing which Guard is deployed certainly doesn't change the statutory analysis. There's no US DOJ lawyer who should defend this.
