A material planning consideration is something a council is legally allowed to take into account when deciding a planning application.

The recent High Court case of Animal Equality UK v North East Lincolnshire Council & ASL New Clee Limited [2025] EWHC 1331 (Admin) set an important principle: animal welfare can be a material planning consideration.

The Animal Welfare Act 2006 was meant to protect animals from unnecessary suffering – physical or mental.

But too often, the focus drifts from the protection of animals themselves to legal loopholes and excuses, which allow suffering to persist.
In 2022, together with @animalequality, we put together a report on #TheEnforcementProblem.

Our report revealed widespread and systemic under-enforcement of the legal frameworks meant to protect farmed animals, between the years of 2018 to 2021.

All we need now is for the UK government to recognise this by issuing detailed official guidance setting out what the legal protections for crustaceans mean in practice.

Only then will enforcement officers and businesses understand: It is illegal to boil a lobster alive.
Four years ago we initiated the legal argument that following their recognition of sentience, boiling crustaceans alive is illegal under the Welfare of Animals at the Time of Killing (England) Regulations 2015 (WATOK), where it is an offence to cause avoidable suffering.

We have all seen it: pictures, footage and depictions of idyllic animal farms where animals are roaming and grazing, adding beauty and character to the countryside.

But what we have seen far less of is the reality for the majority of farmed animals in the United Kingdom…

The law already existed, but this is a major step toward bringing clarity, accountability, and better protection for millions of fish. However, our work does not stop here. We will work to ensure the guidance is as robust and ambitious as possible.

Standard industrial farming practices allow for a whole host of painful practices, including mutilations, confinement and selective breeding.

Official guidance will, for the first time, spell out what the law requires and how farmers must comply – bringing accountability to one of 🏴󠁧󠁢󠁳󠁣󠁴󠁿’s largest farming sectors.

🏴󠁧󠁢󠁳󠁣󠁴󠁿 is the world’s third largest salmon producer. This move has the potential to transform conditions for over 37 million fish.
Until now, no official government guidance for the welfare of fish in their whole lifecycle has ever been put in place. This has left fish vulnerable to abuse, with no clear standards for farmers and no effective enforcement tools for regulators.
After repeated calls from The Animal Law Foundation, the Scottish Government has now committed to introducing official guidance on the welfare of farmed fish – a long-overdue step that will better protect millions of fish.
