By "court" I do mean PayPal here will only recognize it if it’s reasonable, mutually agreed upon, and not in violation of existing laws. The “No refunds regardless of the reason” is too broad to hold water, ESPECIALLY when no work was started.

Oh I did read their TOS ahead of the commission. There's A LOT of flaws.That alone indicates that they haven't refined their TOS correctly.Even if they had in their TOS "No refunds for any reason" their TOS it's not magical shield that overrides consumer protection laws or basic contract principles.

Did a little digging on this guy and as usual they are not real but a scammer. Since somebody else in the fur community has the exact experience. He is being reported but they just keep coming & using the words "I came from Barq." It's becoming a meme at this point. Not good./2

I like @barq.app app but if I am going to be honest and it is not Barq fault here, it's bad apples giving the app a bad rep. For example I am constantly getting users with similar messages like these all the time for the past 3 weeks now. Either via TG DM or Discord DM. 1/
