The dissent also notes that communicating directly with an adverse, represented party about an ongoing lawsuit rather than counsel of record is both an ethical violation and an indication that no contract pertaining to the lawsuit was formed in the click-thru process.
The NY Court of Appeals held today, 5-2, that the woman's act of clicking through meant she agreed to arbitration, and her lawsuit had to be dismissed. The dissent protests that it's ridiculous to believe the woman's click meant she actually agreed to give up her lawsuit in favor of arbitration.
