There has been a rise in certification disputes since the 2020 election. These delays or refusals risk disenfranchising voters and disrupting the peaceful transfer of power. The Georgia court decision clarifies that certification is a mandatory, impartial process.

The case involved a Fulton County election board member who refused to certify the results of the 2024 presidential primary. The court determined that certification is a ministerial act, meaning officials must confirm reported results regardless of personal beliefs.

Last month, the Court of Appeals of Georgia affirmed a lower court’s October ruling that local election officials have a legal duty to certify results—even if they personally disagree with the outcome.

The dissent argued that the 8th Circuit’s decision goes against years of precedent of Voting Rights Act cases brought by private plaintiffs. Now, the Supreme Court can decide to hear the case and determine if citizens have the power to stand up for their voting rights.
