It's fake in the way that the California speed limit is fake until you're more than 15 over it. Federal enforcement has so much friction that they only move on charges that are worth their time.

mostly unrelated because I'm seizing an opportunity to mention a factoid I've been obsessed with lately but did you know there's a known flavor in wine tasting called "foxiness" ? It basically disappeared from the tasting world because foxy wines aren't popular but vintners still know about it
