To clarify on this point, Sotomayor is correctly noting that in states where the AGs are not opposing the birthright citizenship EO it will be on individual plaintiffs to vindicate their rights and try to challenge it but that for now SCOTUS has no reason to review the merits anytime soon
7/ As usual, the dissents lay out the actual case and what is going on here. Sotomayor says the quiet part that the dissenters were trying to bring out at oral argument:
