✍️ In this paper, which is upcoming in the Revue du droit des étrangers (FR), I analyse the case-law of European Courts. In various rulings, the CJEU and the ECtHR required Belgian Immigration Courts to consider all relevant facts and circumstances ex nunc. More here: hdl.handle.net/2268/326539 3/3

✅ Based on a large consultation with the relevant actors, the independent expert Commission (which was in charge of overseeing the codification of Belgian migration laws) identified the ex tunc requirement as a major obstacle to fair and efficient proceedings. 2/3
