The distinction between protesters and innocent bystanders is nil. Protesters are innocent. Bystanders are innocent. It is illegal to murder either. Even if protesters attacked a gestapo ICE Nazi, it would still be illegal for the ICE Nazi to murder them. ICE is a gestapo death squad.
