Rawadari has recently obtained a copy of the “Criminal Procedure Code for Courts” (De Mahakumu Jazaai Osulnama) signed by the Taliban leader, Habatullah Akhundzada, and circulated to the courts at the provincial level across Afghanistan for implementation.

The International Court of Justice (ICJ) cases are only between countries—not groups like the Taliban. So the case would be against the State of Afghanistan. However, since the Taliban is the de facto authority, they would be held responsible.

Only governments can bring cases to the ICJ—not individuals or organizations. To take Afghanistan to the ICJ for violating CEDAW, a country must have ratified CEDAW and accepted the Court’s jurisdiction under Article 29.

Afghanistan is a party to CEDAW, the global treaty protecting women’s and girls’ rights. By accepting Article 29, Afghanistan granted the ICJ authority to hear disputes about violations.
