My own view on anisogamy and current political debates in the US is: a pox on both your houses. Both sides are committing the naturalistic fallacy (i.e., confusing is with ought). Each side wants to enlist Science to determine how we ought to organize our society, but science can’t do that. It can’t substitute for priests, pastors, politicians, and other community leaders. It can't substitute for the debate and compromise among members of a community regarding the social rules and roles they want to live by. The reason is: scientific concepts and theories are always subject to challenge. Today, most evolutionary biologists regard anisogamy as the best approach to defining females and males, but not all agree, and tomorrow new theories or evidence could overturn the current consensus. And that's true for any scientific concept or theory. Basing humans rights and responsibilities on scientific concepts and theories would be disastrous for human rights because new science could undermine those rights. It would also be disastrous for science because it would become taboo to challenge the “scientific" basis for important rights and roles, and science would grind to a halt. Science can *inform* public policy, but it can’t determine it. Let me illustrate my points with school sports, alluded to in the Executive Order’s reference to Title IX. Nothing in biology says that humans must hold sporting events, that these events must be organized in a certain way, or that they must include this or that event. Those are all decisions that the various communities must decide for themselves. Science can inform those communities what the likely outcomes would be for particular events based on what we know, and don’t know (!), regarding the effects of age, biological sex, training, hormone levels, various intersex conditions, and so forth, on performance in such events. But then it’s up to community, not science, to consider that information and come to a decision about what to do.
