It’s very hard to feel empathy for masked jackbooted military thugs. Perhaps ICE would be treated better if they looked liked people and not evil fascist henchmen.

I think the proper way to deal with unrealized gains, broadly, is to treat any use of assets as collateral as a mark-to-market taxable event. Simply put, you shouldn't be able to utilize unrealized wealth if you're not willing to pay gains taxes on it i.e. contribute to society. How this would work:
