One thing that got a little smushed yesterday at the Comey arraignment is that, in his 2d round motions, he may make a "Bronston literal truth" motion to dismiss. After learning more about the accusation, he'd argue that his answers, when compared to what govt claims, were true as a matter of law.

As I read it, the 9th Circuit's administrative stay of the 1st TRO in Portland allows federalization of the Oregon National Guard troops for now *but still bars deployment of any NG troops in Portland.* That's because 2d TRO was not appealed & barred deployments of any federalized NG troops.

In today's hearing in Widakuswara v. Lake re: the dismantling of Voice of America, Judge Lamberth just indicated he intends to issue an order later today enforcing his prior preliminary injunction, which—if as requested by plaintiffs—would pause RIFs there.

What you see happening in both the Guatemalan children’s case and the Ghana pass-thru case is that the Trump Adm seems to be incentivizing or pressuring foreign nations to make phony diplomatic “requests” or “assurances” that it then uses to try to evade judicial review of dubious removals ...

APPLICATION TO STAY THE PRELIMINARY INJUNCTION
OF THE UNITED STATES DISTRICT COURT
FOR THE DISTRICT OF COLUMBIA AND REQUEST FOR ADMINISTRATIVE STAY
Pursuant to Rule 23 of the Rules of this Court and the All Writs Act, 28 U.S.C.
1651, the Solicitor General-on behalf of applicant Donald J. Trump, President of the United States-respectfully requests that this Court stay the preliminary injunction issued by the U.S. District Court for the District of Columbia (App., infra, 23a) pending appeal to the U.S. Court of Appeals for the D.C. Circuit and any further proceedings in this Court. The Solicitor General also respectfully requests an immediate administrative stay of the preliminary injunction.
This application involves yet another case of improper judicial interference
with the President's removal authority-here, interference with the President's au-
thority to remove members of the Federal Reserve Board of Governors for cause.
The Federal Reserve Act, ch. 6, 38 Stat. 251, broadly authorizes the President
to dismiss members of the Board of Governors "for cause," without further restricting
permissible types of cause. 12 U.S.C. 242. In August 2025, the President determined that cause existed to remove respondent Lisa Cook from the Federal Reserve Board.

V. Conclusion
For all these reasons, the Court finds that Plaintiffs are entitled to certification of their
proposed class of certain unaccompanied alien children from Guatemala and to a preliminary injunction. Thus, the Court will grant their motion for class certification and provisionally certify
the class described above. In addition, the Court will grant Plaintiffs’ motion for a preliminary
injunction. And it will order that Defendants, their agents, representatives, and all persons or entities in concert with them are enjoined from transferring, repatriating, removing, or otherwise
facilitating the transport of any Plaintiff—including both named Plaintiffs and all members of the
provisionally certified class—from the United States. Finally, the Court will require Plaintiffs to
post a $1.00 nominal bond by September 22, 2025.

In the Ghana refoulement case, Govt has agreed to make its declaration, by State Dept official Jonathan G Pratt, available to plaintiffs.
Pratt is the senior bureau official for State's Bureau of African Affairs.

Defendants agree to provide to Plaintiffs' counsel of record the September 13, 2025,
declaration of Jonathan G. Pratt provided that this Court issues a protective order prohibiting Plaintiffs' counsel from releasing or sharing the declaration with anyone, including the public or any foreign government or court. We also request that this Court order Plaintiffs to redact portions of any public filing that references or includes the information in the declaration.

In D.A. v Noem (chain refoulement case through Ghana) Judge Chutkan wants to know by 1:30pm today why she shouldn't order it to at least show plaintiffs the declaration it filed last night (albeit under protective order from public disclosure).
