Well… they’re the National Guard Reserve--but if the President sends them, they legally stop being state troops & fall under the regular U.S. Army chain of command (Title 10 of the U.S. Code), so it’s fair to call them the U.S. Army.

No pay, no food, & no sitting around--It's like ad-hoc Fat Camp!

What crimes and where are you all talking about?

Location matters. You don't have to be a party to the ICC, but if you commit crimes against a country that IS party to the ICC then an American can be charged. At that point the US doesn't have to give you up, but leave the US and you're fair game.
