The loudest of the anti-AI crowd here was always what it is, and that's a shame. Recently some bigger accounts have allowed themselves to become so negatively polarized by them that they basically exist to dunk on the lowest hanging fruit, and that's a shame too.

That’s also very bad!

I still think there'd be some First Amendment issues to work through depending on which part of the cooperation the state was objecting to. But that would definitely be the right process. And process matters!

People were being way too nice to me on this site for the last month anyway.

Those are and I may well be proven wrong here, which would be great. But I still think it’d be nice for the governor to clarify that rather than make it sound like he’s just going to unilaterally cut off funding because he’s pissed.

Also, I welcome you to the group ratio :-).

Alan is gonna get ratio’d on this one and I don’t know enuff to know if he’s right on the law, but he is right on the principle: beating Trumpist illegality means insisting on the rule of law & its norms, not capitulating to the logic of extortion.

OK, but how would that not be just as illegal as what the federal government is doing here?

IF ANY CALIFORNIA UNIVERSITY SIGNS THIS RADICAL AGREEMENT, THEY'LL LOSE BILLIONS IN STATE FUNDING — INCLUDING CAL GRANTS — INSTANTLY.

CALIFORNIA WILL NOT BANKROLL SCHOOLS THAT SELL OUT THEIR STUDENTS, PROFESSORS, RESEARCHERS, AND SURRENDER ACADEMIC FREEDOM.

Clearly I woke up this morning and chose violence.

That wouled certainly be the more legally appropriate way to go about it. Though there still might be 1A concerns.

FWIW I do not think “working with the legislature” is the most natural reading of Newsom’s ALL CAPS tweet.

The federal “compact” seems obviously illegal.

My point was primarily about executive power, which is how we got into this mess in the first place. I’m not interested in replicating executive branch lawlessness at the federal level.

Yes but the state of California is not the same as the governor of California.

Yes if the agreements are entirely at the discretion of the governor. But is that how these agreements were structured? The whole issue is that this is the problem with the federal government actions. Would be nice if the leader of California addressed that rather than just YELLED AT UNIVERSITIES.

Yes the federal compact is awful! No question.

(BTW, your profile description is awesome!)

I appreciate the honesty!

It's not a First Amendment issue—it's a question of whether the governor of California has the power under California law to withhold state funds from universities because he doesn't like what they're doing. Presumably the original appropriations came from the California legislature.

If I need to do a eating-crow self quote-tweet, I will certainly do so!
