If we're in the "war" context that the WH keeps insisting exists, then this interpretation is not a stretch, and should be prosecuted.

Like many of my colleagues who have fought the excesses of the "War on Terror" for a generation, I do not believe any election cycle is going to change this course. Only accountability - investigations, transparency, prosecutions - can restore (or trigger) democracy in the long-run.
