The funding for ICE was bolstered by the most recent spending bill (BBB) and therefore is virtually unaffected by the appropriations that must be approved by Congress to avoid a government shutdown.

Remember the big legislation they passed in July? It provided tens of billions of dollars to ICE. That money isn't part of the appropriations (taxpayer money disbursed by Congressional mandate) process. The shutdown means the appropriated funds aren't going out, not every single cent of gov. funds.
