Think about the attacks on DEI. And Trump attacking institutions for their DEI programs. What is DEI? An intentional way of discriminating against white people when it comes to employment or school enrollment or whatever. That will be their argument.

Think about all the white grievance lawsuits and what they have been alleging. That set asides of venture capital for Black women is discrimination against white people. (That's the Fearless Fund case.)

The only way that Black people will be able to be successful in anti-discrimination lawsuits if disparate impact liability is eliminated is if they prove racial animus in the mind of the person doing the discriminating.
