When it comes to immigration, DHS and DOJ both take direction from SM. When Abrego was released in TN, lawyers received email he would be removed to Ghana. Rep from ICE testified Ghana was chosen by HSC in White House, but claimed executive privilege when questioned. Head of HSC is SM.

He can't go to Costa Rica on his own, would be fleeing his criminal charges. BTW, I think his lawyers have his passport by Xinis's order when government claimed they wanted to send him to Liberia. The threats to send to Africa were part of plan to maintain custody and apply pressure in criminal case

I think this case may provide an important test of the "border exception" to warrant-less searches as applied to electronic devices, where existing case law is inconsistent across Circuits.

Correct, DOJ requested release of grand jury material in three cases, one SDFL and two in SDNY. No significant info not already in public record (according to at least two of the judges).

It’s not really true they have been trying to remove him, it’s a detention and pressure tactic. DHS and DOJ are on the same page. If the criminal case starts to crash (and it might), different story.

May not be his best tactic, but he can also file for asylum. Denied in 2019 since more than 12 months from last arrival. Tried after brought back from El Salvador, but denied because of the supposed final order of removal. Last arrival was in June.
