No. Only when federally activated under Title 10 of the U.S. code for national defense objectives. They live in Title 32 under the command of the State Governor. When activated for SAD they are state employees. You can look it up in the Uniform Code of Military Justice if you're curious.

Ice in its current iteration is acting outside of its authority and in direct violation of multiple federal court orders as well as the US Supreme Court. It is now a lawless agency. Congress must stop this.
