Nope - exactly why paragraph 1 says 'would otherwise' be destitute. Paragraphs 2 & 3 say 'you can stop yourself from being destitute', and paragraph 4 says 'you broke the law so we won't stop you from being destitute'. Paragraph 1 is separate and not bound by the rules of 2-4, hence 'discretionary'.

No, it doesn't. The 'also' in this sentence is the giveaway - it's not saying 'you will receive support unless you break the law'. It's saying 'you will definitely not receive support if you break the law, but you might also not receive it if you don't'.
