Maybe the bridge here is that the effectiveness has to be tied to a legit relationship with different communities. I guess I don’t think it matters how good the EPA is if it isn’t seen as vindicating, eg, Black Americans in an intergenerational struggle against the effect of environmental racism.

I think anybody who tells you that experiments along the lines I’m talking about won’t affect efficacy is selling you something, watch your wallet.

It’s all about the diagnosis of the problem. If you think the modern state needs political legitimacy for admin, then we need to get going . . .

As a historical matter, this decline started before I was born. But we’re reaching a breaking point that evidence a crisis in authority. Paying homage to the old gods no longer seems viable.

I think this is part-and-parcel to a decline in expertise-based authority that’s more central to discussions in admin law. This is a huge problem across the board.
