Even if he did sustain some kind of injury in the incident, it is still Officer-Created Jeopardy. Officers cannot place themselves in jeopardy - especially when violating policy by doing so - then use that jeopardy to justify deadly force. "Moment of threat" defenses are no longer valid, per SCOTUS.

It’s still Officer Created Jeopardy. He placed himself in the path of a moving vehicle, creating the jeopardy he used to justify killing her. That’s still murder.

I think judges have limited involvement in grand jury proceedings. If the US Attorney (appointed by Trump) is going to pursue charges against the agents, it is doubtful anything will happen to them from that avenue. Cases should be brought by those whose rights are being violated.

It's not just gerrymandering. Pick a red state, any red state and look at the number of registered voters who didn't vote (registered voters minus total votes cast). The look at the margin of victory by Republicans in their state. Red states are red because often a third of their voters stay home.

If those people didn't vote for this, then why didn't they vote? Why did 1/3 of Texas voters stay home in 2022 and 2024 allowing Abbott and Trump to win by margins that could have been easily overcome? By not voting, THEY VOTED FOR THIS.
