I’ve been a lawyer and a scientist, but not in that order
One of the many things I don’t understand about this is why these guys are in full front-line military dress, complete with helmets and assault rifles — and the assault rifles are at the ready. This is happening in an American home, with children.

The smugness of both of these jerks is a sight to behold

What incredible arrogance

I could not agree more

You also note: “To be clear, I am not arguing that the Constitution unambiguously establishes this congressional power.”
January 8, 2026 at 3:06 AM
Condescendingly saying the Constitution contains this power doesn’t make it so, even if you’ve written about it. In fact, your article describes the “argument” for your interpretation as “far from a conclusive one.”

One of the many things I find inexplicable about this horror is why the shooter even had his gun out. What kind of “training” teaches you to pull out your firearm in a situation like this?

I hope you also go to the other end of the subway car

The state official involved (DA or AG) remains as the prosecutor in federal court after removal, and the law applied is state law

Serious answer. If part of the U.S. govt takes possession of money/property from Venezuela and hands it to Donald Trump, that is an appropriation to Donald Trump and must be authorized by law as well.

If a check/gift goes directly to Donald Trump, it's a bribe/emolument.

I think the idea is that this money never gets to the Treasury.

Yes, he got away with it, and he should not have. But he didn’t “seize” power. He was elected. And that’s one of the most disturbing aspects of our society and our time — that millions of our fellow Americans voted for this person.

Truly Orwellian. Stunningly Orwellian.

The cynics think today's attack on Venezuela is staged and transactional. Maduro is allied with Putin, but in 2019 Putin offered Trump a swap: Russia cedes Venezuela and gets Ukraine. (See Fiona Hill's testimony in Trump's first impeachment trial, h/t @davetroy.com). Even Maduro may be in on it. 2/

What the hell does that even mean??

Wouldn’t it be great if, in addition to entities like the National Security Council, there were a National History Council tasked with making sure our dear leaders are provided with some accurate historical context for their actions?

Hmm, what do all three of those countries possess, in abundance? “Oil that is, black gold, Texas tea …”

I dunno about low key — I LOLed when I read that, I mean come on

Your last two points are incredibly important — that the dissenters simply accepted the govt’s claims as true, rather than review the district court’s findings that were based on both parties’ submissions. They know the standard of review — they just chose to ignore it. “Deeply worrying” indeed …

Either they automated the review for initials of victims and didn't bother to check the accuracy (or couldn't care less about accuracy) or the reviewers are completely incompetent (or both)
