It was dismissed without prejudice. Her shenanigans in securing the indictment should have led it to being dismissed with prejudice, and she should have been disbarred. This is like a 15-yard chop block penalty being overridden by a 5-yard illegal formation penalty prior to the snap.

My only point was that it was well received critically. I didn't mean to be a jackass. I agree that some Springsteen loyalists were disappointed, but I definitely wasn't one on them. I was only 17 years old when Nebraska was released and I thought it was mind blowing.

They tried to ignore the first round of No-Kings protests. That was the smarter strategy. Proclaiming now that the protests are somehow "dangerous" simply gives away their game. It acknowledges MAGA's dependence on authoritarianism.

You are conflating 2 different issues. Your original point was oligarchic, that the system never worked because the wealthy run the show. If true, it should be true irrelevant to party. Your latest point is constitutional. But checks & balances do not work now because one party holds all the levers.

Sure. As you say Dave Marsh was using the term in Creem as early as 1971. (I 1st read that article 40 years ago in the 1985 anthology of his work.) Lester Bangs probably used the term there as well. But the NY Times had quite a bit wider readership than Creem (or whatever Bomp! was)
