As a first time player it's an incredibly feels bad situation for pat but continuing to play with a jimmy could be even worse

If the DM won't then the party's gotta convince him or the host, it's a shitty situation but that's what has to happen to Jimmy. Either that or waiting until jimmy inevitably blows up on the party or the DM, then the DM can kick him guilt free, but who knows how long that could be

I don't sympathize with jimmy but using in game conflicts to act on out of game grievances is almost never a good idea. Just kick the jimmy and be done with it, keeping him in will only make the game worse for everyone.
