The president's conditional ability to grant a 90 day extension is written into the law. There was no point in Biden doing it, the SC would just say he did it wrong which was a risk TT couldn't (and didn't) take.

Exactly. An outgoing mayor could say "I'm not prosecuting the marijuana laws that are on the books" for a day, but all it takes is the guy taking office tomorrow to say, "nope, we're still prosecuting those people that got arrested yesterday". Unfortunately, shutting down was prudent.
