Well because immigration offenses are civil in nature, would that materially change the underlying analysis? The case you cite @orinkerr.bsky.social deals with an armed robber, obviously someone who has been seen perpetrating a criminal offense with a weapon.

It's possible they are simply two of the three judges on the motions panel which rotates every month I believe. Just a bad draw just like back in June with the AEA case

Yes, if you missed it, the June motions panel is literally the best motions panel possible for Trump. It is his three appointees.
